Media License

Effective October 2026

PRO360 Photos keeps the copyright to all photos, videos, 3D tours and floor plans it creates. Every order includes a license for the listing agent and their brokerage to market the property, on the terms below. Agents accept this license before downloading their files.

1. Ownership

PRO360 Photos owns the copyright to all media delivered for an order. Payment grants a license. It does not transfer copyright.

2. Who is licensed

The agent who placed the order and their brokerage, for the property address on that order only.

3. Marketing license

The licensee may use the media to market the property for sale or lease, for as long as they market that listing:

• HAR and other MLSs
• Listing sites such as Zillow and Realtor.com
• The agent’s website and the property website
• Social media and email
• Print materials, flyers, signs and open house materials

4. MLS license (HAR MLS Rules, Section 11)

For media submitted to an MLS, PRO360 Photos grants a perpetual, worldwide, royalty-free, non-exclusive license to copy, distribute, display and create derivative works of that media, including the right to sublicense those rights to the MLS. This covers MLS syndication and the license the MLS requires under its rules.

5. Uses that need a separate license

These uses are not included and need written permission from PRO360 Photos:

• Another agent listing the property later (HAR Rule 1.25)
• Sellers, buyers, builders, stagers, designers or property managers
• Rental or vacation rental listings not marketed by the licensee
• Agent branding, advertising or promotion beyond the listing
• Reselling, stock use, contests or AI training

6. Editing and MLS compliance

The licensee may crop, resize and add text or branding where the platform allows it, but may not alter the property itself. The licensee is responsible for MLS compliance, including:

• Labeling virtually staged images in the HAR Photo Description
• Adding HAR’s watermark, “Image does not represent actual property as is,” to any altered image (Rule 1.25.1)
• Using the unbranded video and tour versions on HAR

7. Music

Music in PRO360 videos is licensed for HAR, YouTube, Facebook, Instagram, the agent’s website and the property website. Music may not be separated from the video or reused elsewhere. The no-music reel version is for adding sounds inside Instagram or TikTok.

8. Changes and transfers

This license cannot be transferred. If the agent changes brokerages while marketing the listing, contact PRO360 Photos to update the license.

9. PRO360 Photos’ use

PRO360 Photos keeps the right to use the media to promote its own services, including its portfolio, website, social media, paid online ads, print advertising and award or contest entries. PRO360 Photos will not publish the property’s street address in its own promotion, and will remove a specific image from its own promotion on written request from the seller or the listing agent.

10. Signed agreement on request

On request, Mario will sign the Texas REALTORS Model License Agreement or the brokerage’s own license agreement.

11. Acceptance

Agents accept this license electronically before downloading their files. Acceptance is recorded with the order and applies to the agent and their brokerage.
